Cops: Man accused in cop's death had recent DWI arrest

A Plainview man accused of killing a Suffolk County police officer while driving drunk early this morning had also been arrested last month for drunken driving in Nassau County.

Suffolk police said that Jose Borbon, 23, was trying to make a left hand turn in his 2007 Dodge Magnum on Commack Road at Vanderbilt Motor Parkway in Commack at 4:15 a.m. today when he hit a Suffolk County police officer's car.

Suffolk County Chief of Detectives Dominick Varrone said the police vehicle appeared to have spun around, struck a traffic pole and immediately burst into flames.

The officer, whom police did not identify pending notification of his next of kin, was unable to be rescued because the car ignited so quickly and fully, Varrone said. At a press conference today, Varrone said the vehicle was destroyed to the point that it was not even recognizable as a police car.

Borbon, who was not injured in the collision, stayed at the scene. He was arrested and taken to the Suffolk Police Department's Fourth Precinct, where he was charged with driving while intoxicated. Borbon is scheduled to be arraigned on Monday at First District Court in Central Islip.

According to court records, Borbon was arrested in Nassau County on Jan. 4 and was charged with DWI, holding more than one license, criminal possession of a weapon, not signaling, driving without a seat belt, and failure to obey a traffic device. His next court date in that case is in April.

Borbon held a D-class "conditional" license that was issued on Feb. 5, records show. A conditional license is limited and allows a driver to drive only to specified locations, such as a workplace.

Borbon also was involved in four separate accidents in 2006, records show, and his license had been suspended once before in 2007.

Flags flew at half-staff at the Suffolk County Police Department today in memory of the officer, who had served on the force for more than 20 years.

He had worked in Suffolk County's Second Precinct, which is based in Huntington. At the time of the crash, he was on his way to aid a fellow officer who had stopped a vehicle with stolen license plates at Hauppauge Road and Commack Road. That officer heard the collision from where he was stopped nearly a mile away.

The Second Precinct squad stood in formation and saluted as the fallen officer's body was brought to the Suffolk County Medical Examiner's office this morning, Varrone said.

"He was a great police officer, a great family man, a great husband and father," said Jeff Frayler, president of the Suffolk County Police Benevolent Association, "and we all suffered a great loss."

Varrone said the police department was "devastated."

Mourners laid red and yellow flowers at the site of the crash, which is near the Bonwit Inn. One man who brought a bouquet identified himself as an emergency medical technician with the FDNY.

Suffolk County Executive Steve Levy issued a message of condolence to the officer's family.

"This officer made the ultimate sacrifice protecting and serving the people of Suffolk County," Levy said.

Suffolk Police Commissioner Richard Dormer said his department was in mourning, adding: "It's a sad reminder of the dangers police officers face each and every day."

The last Suffolk officer to be killed in the line of duty was Edwin Hernandez, who died in a single-car accident on July 27, 2004.

Today's crash brings the number of officer deaths in the line of duty to 22 since the department's creation in 1960.

Suffolk police are asking that anyone who witnessed the collision contact Fourth Precinct detectives at 631-854-8452.

Police Officer Glen Ciano was killed when his patrol car was struck by a vehicle being driven by an intoxicated operator.

Officer Ciano was responding to assist a fellow officer who had stopped a vehicle with stolen license plates. His patrol car was struck by a vehicle making a left turn onto Commack Road from Vanderbilt Parkway. The force of the collision sent the patrol car off the road and into a utility pole. The patrol car burst into flames, killing Officer Ciano.

The suspect was arrested at the scene and it was determined that he had been operating his vehicle under the influence of alcohol.

Police Officer Ciano had served with the Suffolk County Police Department for 22 years and is survived by his wife and two children. He was assigned to the 2nd Precinct.

The sad fact is that this wouldn't even count as his 2nd offense here for the purpose of enhanced sentance, since the first offense is still being adjudicated.

New charge, higher bail for suspect accused in crash that killed Officer Glen Ciano

The Plainview man accused of being drunk at the wheel when he collided with a police cruiser, killing a Suffolk officer, faces increasing legal peril after prosecutors said his blood alcohol level was more than twice the legal limit.

For the second day in a row, Jose Borbon, 23, stood in a Central Islip court Tuesday to face charges that he was drunk when he and Officer Glen Ciano collided before dawn Sunday in an intersection in Commack. Ciano, 45, a veteran Second Precinct officer, was killed when his cruiser hit a pole and burst into flames.

John Collins, Suffolk County's chief trial prosecutor, said a preliminary test of Borbon's blood showed an alcohol content of .19, far surpassing the legal limit of .08. Because the blood alcohol content exceeded a statutory limit of .18, prosecutors additionally charged Borbon - already charged with one count of misdemeanor drunken driving - with aggravated drunken driving.

However, based on a number of factors, such as the blood-alcohol content and the circumstances of the crash, it is likely he will face upgraded felony charges. Prosecutors this week said Borbon could face a homicide charge. This could include the crime of second-degree manslaughter, which is recklessly causing someone's death.

Collins noted that more than three hours passed between the crash and the drawing of the blood. "I think it follows logically and scientifically that that (the BAC) was well higher at the time of the crash," he said.

Borbon's attorney, William Petrillo of Rockville Centre, declined comment.

At the arraignment, Borbon, dressed in green jail scrubs and laceless black shoes, pleaded not guilty. His family again sat silently in a crowded audience dominated by dozens of Suffolk police officers.

While the new charge is also a misdemeanor carrying a maximum sentence of one year, the blood test result could be the critical factor in how a grand jury will perceive Borbon's actions, legal experts said.

Based on the "considerably high reading," Garden City attorney Stephen LaMagna said prosecutors would argue Borbon's alleged intoxication level was a "voluntary, reckless act" requiring a high-level felony charge.

"I think there is a high likelihood they will charge the defendant with the highest homicide they can . . . and that will be manslaughter two," LaMagna said.

The blood evidence prompted District Court Judge Patricia Filiberto to raise Borbon's bail from $75,000 to half a million dollars. Petrillo called the bail "perhaps the highest this court has ever set for a misdemeanor."

Petrillo asked prosecutors and the judge to ensure surveillance videos taken from a gas station near the crash site are "carefully preserved."

Borbon is scheduled to return to court on March 25.

He's been collared for weed in florida. He shouldn't have been on the road.

He's beign held on 1/2 million bail, and could and probably will face man 2 charges. 5-15.
